Pedestrians Wearing Headphones Near Traffic Are At Risk

A new statistical study has revealed that deaths and serious injuries involving pedestrians wearing headphones have increased more than three times what they were six years ago. Pedestrian versus car and pedestrian versus train were included in the study. As a Palm Springs pedestrian accident lawyer I have noticed the increase in personal injury claims resulting from pedestrian accidents. Although the driver of the car that strikes a pedestrian may have been the primary cause of the auto accident involving a pedestrian, the pedestrian who was wearing headphones at the time of the accident may be charged with contributory negligence for being unaware of the danger of the traffic because of not being able to hear the sound of cars in the vicinity of this strolling pedestrian. More than half of the crashes involving pedestrians were with trains, not automobiles. In many of these accidents there was proof that the driver of the car sounded their horns prior to the crash, which the pedestrian probably didn't hear because of the headphones. The headphone car crash study found that more than two-thirds of the pedestrian victims were male. Two thirds were under the age of 30. In 25% of the reported accidents the driver had blown his horn before the crash.
