We filed a wrongful death lawsuit on behalf of the surviving adult children of an 85-year-old woman who died in an automobile accident. The woman was being transported from a nursing home to a doctor’s office in a “wheelchair transport van.” The driver of the transport van failed to properly secure the 85-year-old woman in her wheelchair before transporting her to the destination. Our lawsuit claimed that the transport driver did not use the shoulder harness and only used the lap belt portion of the seatbelt system to secure the 85-year-old woman. As a result of the driver’s negligent actions, we filed a lawsuit against the transport van company that employed him.
While the driver of the van did not cause the accident, the 85-year-old woman was thrown forward in her wheelchair. Because she was only secured with a lap belt, the force of the impact caused devastating internal injuries to her abdomen and chest area. The woman suffered lacerations of blood vessels, which resulted in extensive bleeding that eventually led to her death while she was being transported from the accident scene in an ambulance. Another law firm represented the grandchildren in this lawsuit.l
Although the defendant’s legal team hired experts to offer countering opinions regarding the van driver’s use of the lap belt and the frail condition of our clients’ grandmother, we were able to refute these claims and secure a $500,000 settlement for our clients.
